The Dutch Ministry of Justice has stressed their opinion that poker would remain a game of skill and not a game of chance. This question was recently discussed when a professor of statistics and mathematical probabilities challenged the 1998 Supreme Court ruling which defined poker as a game of chance.
Professor Van der Genugten presented a formula to the Ministry of Justice which explained that poker required a much higher level of skill than other games of skill and thus should be defined as one.
In response, the Dutch Minister of Justice, Hirsch Ballin, said that poker would not be receiving any status change and that even if it did ever get legally recognized as a game of chance, the state would continue to fight illegal poker operators.
